Merck Wants Fosamax Verdict Overturned

Merck Wants Fosamax Verdict Overturned
Drug Discovery & Development - October 05, 2010

WHITEHOUSE STATION, N.J. (AP) - Merck & Co. says it will seek a new trial or even a ruling in its favor after a federal judge slashed the jury verdict against the drugmaker in the case of a woman alleging Merck's osteoporosis drug severely damaged her jaw.
Last June, a New York jury awarded $8 million to Shirley Boles, a great-grandmother from Fort Walton, Fla.
Boles took Merck's Fosamax from about 1997 through 2006. She suffered repeated jaw problems and complications after tooth extractions in 2002. Her lawyer presented evidence that her decayed jaw bone drains through sores in her chin and she can no longer chew food.
Merck appealed that verdict and now the judge overseeing the case has reduced the award to $1.5 million. Merck says it wants the new verdict overturned, too.
